Scope of Work

The entire scope of work is listed in your contract. Additional requests by the customer, after project approval, will result in a written change order for customer approval.

 

Underground Utilities

Pickleball Courts of New England is NOT responsible for any damage to any underground utilities.  This includes dog fences, irrigation lines, electrical lines, unmarked gas lines, cable lines, phone lines, well lines, underground drainage or any other utilities. Digsafe will be called but they do not mark private utilities.  Any private markings needed will be the customers financial responsibility.

 

Property Damage

Pickleball Courts of New England is NOT responsible for any property damage, including but not limited to the landscape or driveway. This is a construction project that requires heavy trucks and equipment.

 

Excavation Clause

The contract price does NOT include any unforeseen issues such as the following: high water table, buried stumps, underground roots, rocks larger than 12” diameter, ledge, organic material more than 10” deep and buried trash.

 

Additional work due to the above will be billed as time and material using the rates listed below:

  • $60.00 per hour for Laborer with Tools
  • $110.00 per hour for Trucking (materials in/out)
  • $125.00 per hour for Excavator and/or Bobcat
  • $25.00 per cubic yard for Additional Processed Gravel
  • Ledge removal rates to be determined.

 

Customer agrees to pay up to $2,500 for unforeseen issues without prior authorization. Any amount in excess of $2,500 will result in a written change order and need approval from the customer prior to any additional work being performed. Issues will be communicated with the customer via phone, text or email in a timely manner.

 

Disposal Fees: The removal of any unforeseen items will result in disposal fees. Customers will be responsible for these fees; receipts will be provided.

 

 

 

 

 

 

 

 

Property Lines

Pickleball Courts of New England are not engineers and/or surveyors.  It is the customers responsibility to confirm all property line locations. Customers should confirm the final location of the court is on your property and meets any of your specific town/city setback requirements (if applicable).

 

Permits

Customers are responsible for all town/city permits if required for the court, fencing and lighting.

 

Warranty

 

Court Tiles and Paint: 5 Year Guarantee

Please note that this does NOT cover damage caused by accidents, improper installation or disassembly by customer, improper care, negligence, abuse, acts of God, or any other cause not arising out of defects in material or workmanship of the components.

 

Concrete Pad: 5 Year Guarantee

This guarantee includes structural defects only.

Warranty is void if site preparation was done by others, any vehicular damage, improper care, negligence, abuse and acts of God.

This does not include non-structural cracks due to freeze/thaw conditions.

 

Fencing/Netting: 5 Year Guarantee

Netting warranty is only applicable for the sports listed on your contract.

Please note that this does NOT cover damage caused by animals, vehicular accidents, improper disassembly by customer, improper care, negligence, abuse, acts of God, or any other cause not arising out of defects in material or workmanship of the components.

 

All other accessories such as hoops, net systems, rebounders, lighting, equipment, etc. are based on the manufacturer’s warranty.

 

 

Payment Terms

Customer agrees to the payment terms stated in your contract. Any deviation from the stated terms will result in project delays.
